"Section 13 providesthat where, on an application by or with the authority of the Attorney General, the High Court is satisfied that, where an inquest has been held, and it is necessary or desirable in the interests of justice ( by reason of fraud, rejection of evidence, irregularity of proceedings, insuffiiciency of injury, the discovery of new facts or evidence or otherwise) that another inquest should be held, the Court may quash the first inquest and order another to be held, either by the coroner concerned or by another coroner for the same administrative area."

Terry Lubbock Fight For Justice

Terry Lubbock campaign to get to the truth in his son Stuart's death continues. This week Terry has contacted Essex Coroner Caroline Beasley-Murray asking for a new Coroners Inquest into Stuart's death. In 2002 the Coroner recorded a 'Open Verdict on Stuart's death.

* Section 13 of the Coroners Act 1988.

Section 13 provides that where, on application by or with the authority of the Attorney General, the High Court is satisfied that, where an inquest has been held, and it is necessary or desirable in the interests of justice( by reason of fraud, rejection of evidence, irregularity of proceedings, insufficiency of inquiry ,the discovery of new facts or evidence or otherwise) that another inquest should beheld, the Court may quash the first inquest and order another to be held, either by the coroner concerned or by another coroner for the same administrative area.

* It should be noted that rule 42 of the Coroners rules 1984 no inquest verdict may be framed in such a way as to appear to determine any question of criminal liabilty on the part of a named person.
